An applicant for a freezing order to preserve assets to meet an unassessed costs order must adduce satisfactory evidence of likely recoverable costs on a party/party basis, not merely solicitor/client accounts. Prior correspondence in which the applicant assented to a particular quantum is relevant to the assessment of the appropriate amount of the freezing order.
