Where a second defendant is joined to proceedings because of the first defendant's ultimately unsuccessful assertion of rights, and the second defendant's cross-claim never needs adjudication because the plaintiff succeeds, the unsuccessful first defendant may be ordered to pay the second defendant's costs under Bullock/Sanderson principles, subject to a discount reflecting commonality of interest and work attributable to issues not caused by the unsuccessful defendant.
