A pro bono referral under UCPR r 7.36 may be refused where the application is made late enough to jeopardise a fixed hearing date, the applicant has experience instructing lawyers, and the applicant has long been aware of the referral mechanism without acting. Joinder of proceedings in different courts and divisions will be refused where the issues are distinct and the applicant does not demonstrate that joinder would facilitate resolution.
