A court is not obliged to raise the possibility of an adjournment of its own motion when an unrepresented litigant's solicitor ceases to act, where the litigant is aware of the ability to seek an adjournment and chooses not to do so. Refusal of leave to amend pleadings on the ninth day of trial is justified where the party has been given repeated opportunities to produce admissible evidence in support of the proposed claim but has failed to do so, particularly where the claim was previously pleaded and then abandoned.
