Where an offender's plea of guilty is delayed because the Crown rejected an earlier plea offer, the reason for delay is generally irrelevant to the utilitarian discount — the discount is determined by the timing of the plea actually entered, not by when the offender first offered to plead. An offender is bound by concessions made by counsel in sentencing proceedings and the Court of Criminal Appeal will be reluctant to entertain arguments that resile from those concessions.
