Even after Muldrock, the standard non-parole period remains an important legislative guidepost, and may have greater significance where the offence is found to be in the middle of the range of objective seriousness. However, where the standard non-parole period is not given determinative significance and the offender has mitigating factors such as prior good character and low probability of re-offending, lesser sentences may be warranted. Sentence structures should ensure each count reflects additional criminality rather than being entirely subsumed within other sentences.
