A sentencing judge who finds an offence falls within the mid-range of objective seriousness and imposes a non-parole period equal to the standard non-parole period without further analysis commits Muldrock error by treating the SNPP as determinative. Where special circumstances are found, the correct approach is to reduce the non-parole period rather than extend the additional term by increasing the head sentence. Even post-Muldrock, the SNPP may have greater significance where the offence is in the mid-range and there are limited positive mitigating factors.
