The mere doing of an act constituting a strict liability environmental offence does not establish negligence; the prosecution must prove beyond reasonable doubt that the offender fell below the required standard of conduct. Where the Environmental Planning and Assessment Act does not provide for recovery of investigation costs, a moiety direction under s 122(2) of the Fines Act 1996 may be appropriate to compensate the prosecutor for investigation expenses.
