A 20-year estrangement initiated and maintained by an adult child applicant, combined with a small fully-distributed estate and competing claims of beneficiaries with whom the deceased had close relationships, may justify a finding that the deceased did not fail to make adequate provision, notwithstanding the applicant's financial need. Delay of almost two years after threatening proceedings, without notifying beneficiaries of a continued intention to claim, while beneficiaries spend distributed estate, will not constitute sufficient cause for an extension of time.
