The offer of compromise regime under UCPR Part 42 r 42.15A applies to family provision proceedings without any special 'carve out', and an unsuccessful plaintiff who fails to beat an offer of compromise will ordinarily be ordered to pay indemnity costs. In small estates, the court will give significant weight to the claims of a beneficiary who was the deceased's principal carer, and an adult child in a substantially better financial position than other claimants may fail at the jurisdictional stage even where the will makes no provision for them.
