The prohibition on physical violence in s 153(3)(a) of the Youth Justice Act 2005 (NT) applies only to force used for maintaining discipline under s 153(1), not to force used for ensuring the safe custody and protection of detainees under s 151(3)(c). Force used for safe custody and protection is governed by s 152(1), which requires it to be 'necessary or convenient' and reasonable (per reg 71(2)), but does not exclude physical violence. Youth workers who use physical force to implement 'at risk' procedures for a detainee's protection are not subject to the s 153(3)(a) prohibition.
