When the entirety of a complainant's recorded evidence is replayed to the jury during deliberations, the trial judge must warn the jury against giving the replayed evidence undue weight and must remind the jury of the defendant's evidence. Earlier directions on onus of proof and credibility assessment are insufficient to address the specific risk of unfairness arising from the repetition. The factors relevant to whether such a warning is required include: time elapsed since the defence evidence and summing up; the character and emotional quality of the complainant's evidence; the stage of deliberations; and the length of the replayed evidence.
