A Calderbank offer made late in proceedings (after reply submissions filed and only three weeks before hearing) that amounts substantially to an invitation to abandon the appeal will not readily support an indemnity costs order, particularly where the losing party's case was not hopeless. The timing and substance of a Calderbank offer are relevant to whether refusal was unreasonable.
