Where an offender was suffering from post-traumatic stress disorder at the time of offending and there is a causal link between the condition and the offending, this has an impact upon the criminality of the offending and can modify the sentencing purposes of deterrence, punishment and denunciation. The residual discretion to admit new (as opposed to fresh) evidence on a sentence appeal may be exercised where psychological evidence of such a condition was not available at the time of sentencing.
