Where an impecunious appellant has modest but not hopeless prospects of success on appeal, security for costs should be ordered at a level reasonably within the appellant's capacity to muster, rather than at a level that would stifle the appeal. The court fixed security at $10,000 where the respondent sought $55,000 and estimated standard costs of not less than $20,000.
