Where an appeal succeeds and a retrial is ordered, the successful appellant is entitled to costs of the appeal on the standard basis, and the costs of the first trial should ordinarily be determined by the new trial judge following the retrial. An indemnity certificate under s 15(1) of the Appeal Costs Fund Act 1973 (Qld) is appropriate where the appeal succeeds on errors of law not attributable to the respondent's conduct.
