The harmful effect of imprisonment on a person with a mental disorder does not, in general terms, preclude the imposition of a custodial sentence. A general practitioner's broadly expressed opinion that imprisonment would be detrimental to an offender's mental health is a factor to be taken into account, but its weight is limited by lack of detail. For possession of approximately 3 kilograms of cannabis for commercial purpose with prior drug history and limited co-operation, 18 months' imprisonment suspended after six months is within the range of a proper exercise of sentencing discretion.
