A parole eligibility date of nine months on a five and a half year sentence for heroin trafficking over five weeks is manifestly inadequate even where there are many mitigating features including Aboriginal background, dysfunctional upbringing, successful rehabilitation program completion, early guilty plea, and promising rehabilitative prospects. Such mitigating features warrant parole eligibility considerably earlier than the one-third mark but not as early as nine months. A parole eligibility date of 14 months was substituted.
