For the purposes of s 16 of the Criminal Code 1899 (Qld), the punishable acts for a public nuisance offence are identified by reference to the totality of the behaviour put before the court as constituting the offending behaviour. Where the behaviour put to the Magistrate included punches that landed on the complainant and caused harm, those acts form part of the punishable acts for the public nuisance offence, and a subsequent prosecution for grievous bodily harm based on the same punches is barred by s 16.
