The voluntary driver of a motor vehicle is 'in charge of' that vehicle for the purposes of the extended definition of possession in s 5(14)(c) of the Firearms Act 1977 (SA), triggering the rebuttable presumption of possession of any firearm found in the vehicle. The presence of a person apparently intoxicated by an illicit substance in a motor vehicle is a reasonable basis on which to suspect that drugs or drug implements will be found in the vehicle, supporting a lawful search under s 52(9) of the Controlled Substances Act 1984 (SA). The question whether persons other than the driver may also be 'in charge of' a vehicle was left open.
