Joint possession of a firearm constitutes primary liability as a principal offender, not accessorial or extended liability, and therefore falls within the serious firearm offender provisions of s 20AAB of the Criminal Law (Sentencing) Act 1988 (SA). A police officer who activates emergency lights behind a parked vehicle and requests a driver's licence does not thereby detain the occupants, provided the officer does not act in a way calculated to restrain their liberty or communicate that they are under detention. Whether reasonable suspicion exists for a vehicle search is a factual question; the absence of a drug-intoxicated occupant (as in Marafioti) does not preclude reasonable suspicion where other circumstances, including the reputation of the location and attempts to conceal items, are present.
