A complainant's use of qualifying language such as 'I think' when describing an element of an offence does not render the evidence incapable of proving that element beyond reasonable doubt; the jury's assessment must be based on the witness's evidence as a whole, including manner and tone. Where defence counsel makes a rational forensic decision not to object to evidence because it supports the defence case, the accused is bound by that decision on appeal.
