The sentencing ranges identified in Hogarth v The Queen [2012] VSCA 302 for confrontational aggravated burglary were specific to the offender in that case and do not constitute a general guidepost for all such offences. Youthful first offenders with good character, significant remorse and excellent rehabilitation prospects may properly receive sentences at the lower end of the range for serious confrontational aggravated burglaries.
