Current sentencing practice for the summary offence of dealing with property suspected to be proceeds of crime (s 195 Crimes Act 1958) in the context of drug trafficking typically involves sentences of 3-4 months' imprisonment with one month or less cumulation or total concurrency. For possession of prohibited weapons (s 5AA Control of Weapons Act 1990), typical sentences are 1-2 months with cumulation not exceeding one month. Sentences of 12 months on each with 3 months cumulation significantly depart from this practice. When a sentencing judge corrects an error reducing the head sentence, the non-parole period must also be reconsidered to give effect to any stated sentencing intention regarding the gap between head sentence and non-parole period.
