The parity principle does not require reduction of an offender's sentence to the point of manifest inadequacy to match a co-offender's lenient sentence. Section 5(2)(c) of the Sentencing Act 1991 (Vic) may prevent the imposition of a manifestly inadequate sentence to give effect to parity. The avoidance of unjustifiable disparity may require reduction to the bottom of the range, but not outside it. The Crown cannot adopt inconsistent positions on the quantity of drugs trafficked across related sentencing proceedings.
