Trafficking in drugs of dependence is no less serious merely because some drugs trafficked were not distributed to ultimate consumers; possession for sale is treated as seriously as actual distribution. Where a co-offender's sentence is said to be so low as to negate its constraining effect for parity purposes, that submission must be made to the sentencing judge and cannot be raised for the first time on appeal. A Director's appeal will be dismissed in the exercise of residual discretion where the sentencing error was induced by the prosecutor's erroneous concession or failure to make appropriate submissions at first instance.
