A public housing authority's decision to terminate a lease under s 64 of the Residential Tenancies Act 1987 (WA) without specifying grounds is amenable to judicial review as an exercise of statutory power, but the RT Act excludes the requirement to afford procedural fairness to the tenant before issuing such a notice. The statutory scheme's permission to terminate without specifying grounds is inconsistent with a requirement to disclose reasons as an incident of procedural fairness. An authority's decision to switch from a s 62 (breach-based) termination to a s 64 (no-grounds) termination is not manifestly unreasonable merely because the authority initially pursued the breach-based route.
