A court should not exercise the discretion under UCPR r 59.9(4) to order a decision-maker to provide reasons where the only ground of review constitutes an abuse of process and no application to amend is made or foreshadowed. However, proceedings involving an abuse of process need not necessarily be dismissed in their entirety — the appropriate order depends on the nature of the abuse and whether the applicant can reformulate the proceedings to cure the abuse. The question whether r 59.9(4) power is available at all where no grounds for relief are stated in the summons was left open.
