Advocate's immunity applies to a lawyer's failure to properly advise a client about a settlement offer where that failure leads to the continuation of court proceedings. The immunity test from D'Orta-Ekenaike must be applied as formulated, and an intermediate court cannot decline to apply it on the basis that the finality rationale is not engaged in the particular case. The approach in Dansar v Pagotto — that immunity does not apply where negligent advice relates to termination of proceedings rather than the manner of their conduct — is rejected.
