A householder who engages a handyman/tradesman from a local newspaper advertisement for minor domestic work such as installing a rangehood does not necessarily breach their occupier's duty of care by failing to make enquiries about the handyman's qualifications or experience, where the contractor implicitly represents competence through willingness to do the work, procurement of materials, and apparently successful completion. The s 5B(2) framework must be substantively addressed even if not explicitly referenced by section number.
