A person who merely contributes material to a television broadcast but has no control over the publishing process will not ordinarily be liable as a co-publisher unless they assented to its final form or otherwise knowingly conduced to the publication. Particulars drawn exclusively from publicly available material (the newspaper article and the broadcast itself) are insufficient to establish co-publication under Webb v Bloch. Where a pleading of co-publication has been struck out twice and the proceedings continue against other defendants, leave to appeal will be refused as raising no issue of principle and no significant injustice.
