An application for appointment of a tutor under UCPR r 7.18 must nominate a specific person as tutor and provide evidence of that person's consent to act; an order purporting to appoint a tutor without naming a person is irregular and will be set aside. The scheme of UCPR Pt 7 Div 4 does not contemplate a bifurcation between the determination of legal incapacity and the appointment of a tutor. The question whether r 7.14 operates as an automatic prohibition on all proceedings (including appeals) by a person determined to be under legal incapacity, in the absence of a tutor, was left open.
