A solicitor who pleads guilty to multiple offences of misappropriating clients' trust funds and creating false documents to conceal the misconduct will be removed from the roll, even where the solicitor consents to removal. The Court must independently satisfy itself that removal is appropriate notwithstanding consent. A practitioner who remains imprisoned cannot demonstrate rehabilitation sufficient to establish present fitness to remain on the roll.
