A specific statutory right of appeal with a time limit (such as s 574 of the Local Government Act 1993 (NSW)) does not impliedly exclude the general right to seek judicial review under s 674 of the same Act or the Class 4 jurisdiction of the Land and Environment Court under s 20(2) of the Land and Environment Court Act 1979 (NSW). A company whose constitutional objects include providing housing to 'low income persons' and providing 'training, vocational and related education, and skills development' has exclusively charitable purposes and qualifies as a 'public charity' for the rates exemption in s 556(1)(h). Land owned by such a charity is 'used' for its charitable purposes even if some properties are temporarily vacant between tenancies.
