Where delay in prosecution results from the offender's own deceptive conduct in concealing the offence, the offender is not entitled to leniency on account of that delay. The two-year maximum sentence available in the Local Court does not cap the sentence available on indictment, though the availability of summary jurisdiction is a relevant consideration providing some amelioration. A conviction for a temporally subsequent offence may properly be taken into account to diminish leniency for earlier offending where it demonstrates the earlier offence was not an uncharacteristic aberration.
