Where the evidence does not permit differentiation between the roles of participants in a joint criminal enterprise, the sentencing court sentences the offender on the basis of criminal responsibility for the full range of criminal acts, without attributing moral culpability for specific acts. The identification of an offender as institutionalised or at risk of institutionalisation does not compel a finding of special circumstances under s 44(2) where the sentencing judge is not satisfied that a longer parole period would result in successful rehabilitation. In aggregate sentencing, it is sufficient for the sentencing judge to indicate which sentences are concurrent and which partially accumulated without specifying the precise degree of accumulation.
