Judicial Commission sentencing statistics have no utility for comparing aggregate sentences because the Commission does not maintain aggregate sentence data. The 'multiple offences' variable does not confine results to multiple instances of the same offence. Comparing a non-parole period for an aggregate sentence with statistics for non-parole periods for single offences or principal offences is methodologically flawed. Counsel relying on sentencing statistics must understand the basis on which they are compiled and the limits constraining their use.
