Evidence of a complainant's prior sexual experience with other adults is admissible under s 293(4)(a) of the Criminal Procedure Act 1986 where the complainants were passed between or among a series of individuals as part of a connected grooming network, as the sexual experience forms part of a connected set of circumstances in which the alleged offences were committed. A trial judge exercising the s 137 discretion to exclude such evidence must consider the legitimate forensic purpose of the evidence and the availability of curative jury directions.
