Where a dangerous driving case involves multiple deaths, extensive prior convictions for driving while disqualified, commission while on parole, and a grossly irresponsible decision to drive with knowledge of a high seizure risk, the case is substantially more serious than the R v Whyte typical case and the guideline serves only as a floor below which the sentence cannot be set. A long-standing frontal lobe injury affecting judgment has only limited mitigating effect on moral culpability where the offender had full knowledge of the risks and had been repeatedly warned.
