Self-induced intoxication by ice (crystal methamphetamine) may properly be treated as an aggravating factor in sentencing where the offender knew from prior experience that drug use increased aggression and continued to use drugs despite that knowledge. A ground of appeal framed as 'insufficient weight' given to a sentencing factor faces a very significant preliminary difficulty because it accepts the factor was considered and must then demonstrate House v The King error. Murder is a protean offence and reliance on comparable sentencing cases is of limited utility given the significance of factual differences.
