The Court of Appeal held that it had no jurisdiction to hear an appeal from an interlocutory decision of a QCAT Senior Member, as s 149 of the Queensland Civil and Administrative Tribunal Act 2009 (Qld) limits appeals to the Court of Appeal to 'costs amount decisions' and decisions by judicial members of QCAT. The appropriate avenue of appeal from an interlocutory order of a non-judicial QCAT member is to the appellate division of QCAT under s 142, with leave required under s 142(3) for non-final orders.
