A sentence of nine years imprisonment for dangerous operation of a motor vehicle causing death and grievous bodily harm while affected by methylamphetamine was manifestly excessive where the dangerous driving was of limited duration and did not involve deliberately reckless manoeuvres. Seven years imprisonment with parole eligibility after two years and four months was appropriate. The distinction between deliberately reckless driving and driving dangerous only because of impairment is significant for sentencing in this category of offence.
