A sentence of four years imprisonment for deprivation of liberty under s 355 of the Criminal Code 1899 (Qld) was unlawful because it exceeded the three-year statutory maximum. An effective head sentence of five years and six months imprisonment for burglary with aggravation and robbery in company with personal violence involving a home invasion with significant violence was within the proper sentencing range. The totality principle was properly applied where the sentencing judge reduced the head sentence for indictable offences to accommodate a cumulative sentence for breach of bail.
