Where non-declarable presentence custody was not brought to the sentencing judge's attention, the appropriate course is to reopen the sentence rather than treat the omission as appealable error; the Court may give credit by reducing the head sentence and parole eligibility date. For extortion involving coordinated vigilante-style conduct with actual violence, a sentence of six years' imprisonment (or five years after credit for non-declarable custody) is within the proper sentencing discretion. Differences in co-offenders' youth and timing of guilty pleas (particularly early cooperation) may properly justify significantly different sentencing outcomes including wholly suspended sentences, without giving rise to a justifiable sense of grievance.
