An adult child suffering chronic mental illness who has been left nothing under a will, and who lacks stable accommodation and the means to provide it, has a strong claim for family provision even where the child has received past financial assistance and has a history of financial difficulties attributable to the mental illness. A protective trust or life interest is not necessary where the applicant has gained insight into their condition, demonstrates fair judgment, and has not displayed pathological behaviour in dissipating assets.
