Boulton v The Queen does not constrain a sentencing judge to impose a community correction order where the seriousness of the offending requires imprisonment to satisfy the purposes of denunciation, general deterrence and just punishment. A CCO is not a 'Get Out of Jail Free' card. In cases of serious drink driving causing injury, particularly where the offender drove in defiance of entreaties and while unlicensed, imprisonment may be the only appropriate sentence.
