A five-year delay between complaint and resolution of charges, during which the offender has undergone significant rehabilitation, may be a powerful mitigating factor warranting a community correction order rather than imprisonment, even for sexual offences against children that involve a breach of trust. The Boulton guideline judgment applies to support the imposition of CCOs where general deterrence, specific deterrence, denunciation and just punishment can be sufficiently reflected in such an order.
