A sentence of 8 years' imprisonment with a 5-year non-parole period for manslaughter by unlawful and dangerous act involving the unintended discharge of a firearm, where there was no intention to harm, falls within the permissible range. Where the Crown accepts a plea to a lesser offence, the factual basis of the plea constrains the material that can properly be relied upon both at sentencing and on a Crown appeal, and the Director cannot seek to advance on appeal a case not put below or rely on material of diminished relevance following acceptance of the plea.
