Counsel appearing on a plea must take objection to inadmissible material in victim impact statements; failure to do so means the appellant must demonstrate on appeal that the inadmissible material actually infected the sentencing process. The characterisation of s 8Q(2) of the Sentencing Act 1991 (Vic) as mandatory does not itself determine the consequences of non-compliance.
