An error in the estimated value of stolen property will not be material to sentence where the sentencing judge's reasons demonstrate that the gravity of the offending lay in the nature of the offences (home invasions) rather than the value of property stolen. A sentence exceeding the maximum available penalty can be corrected under s 280(3) of the Criminal Procedure Act 2009 (Vic) without granting leave to appeal.
